Terms of Service

1. Acceptance of Terms

By accessing or using Curesh, you agree to be bound by these Terms. If you disagree with any part, you may not access the service.

"You" refers to the individual or entity registering for Curesh.

"Services" refers to all Curesh products, applications, and support.

2. Description of Service

Curesh provides:

• •Fleet management and GPS tracking software
• •Temperature monitoring and cold chain compliance tools
• •Mobile applications for drivers
• •Compliance reporting and documentation
• •API access for integrations

The service requires compatible hardware (GPS trackers, temperature sensors) which may be purchased separately.

3. Account Registration

• 3.1You must provide accurate, complete registration information.
• 3.2You are responsible for maintaining account security.
• 3.3You must notify us immediately of unauthorized access.
• 3.4One account per company unless authorized otherwise.
• 3.5You must be 18+ and authorized to bind your organization.

4. Subscription & Billing

4.1 Pricing:

• •Prices as listed on curesh.com/pricing
• •Billed monthly or annually in advance
• •Prices in EUR, excluding applicable taxes

4.2 Payment:

• •Payment due on subscription start date
• •Accepted: Credit card, bank transfer (annual only)
• •Failed payments may result in service suspension

4.3 Changes:

• •We may change prices with 30 days notice
• •Changes apply at next renewal period
• •You may cancel before changes take effect

4.4 Refunds:

• •Annual plans: Pro-rata refund if cancelled within 30 days
• •Monthly plans: No refunds for partial months
• •Hardware: Subject to separate return policy

5. Acceptable Use

You agree NOT to:

• •Violate any laws or regulations
• •Transmit malware or harmful code
• •Attempt unauthorized access to systems
• •Interfere with service operation
• •Use for illegal surveillance or stalking
• •Resell or redistribute without authorization
• •Falsify GPS or temperature data
• •Use to circumvent regulatory requirements

6. Intellectual Property

6.1 Curesh Ownership:

• •Software, designs, trademarks remain our property
• •You receive a limited, non-exclusive license to use

6.2 Your Data:

• •You retain ownership of your data
• •You grant us license to process data for service delivery
• •We may use anonymized, aggregated data for improvements

7. Data & Privacy

• •Data handling governed by our Privacy Policy
• •For EU customers, Data Processing Agreement (DPA) applies
• •You are responsible for data you upload
• •Temperature and GPS data retained per regulatory requirements

8. Service Availability

• 8.1Uptime Target: 99.9% (see SLA for details)
• 8.2Scheduled maintenance with 24h notice when possible
• 8.3Force majeure events excluded from uptime calculations
• 8.4No guarantee of specific GPS accuracy or coverage

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• 9.1Curesh liability is limited to fees paid in prior 12 months
• 9.2We are not liable for indirect, consequential, or punitive damages
• 9.3We are not liable for data loss if you haven't enabled backups
• 9.4We are not liable for hardware malfunctions
• 9.5We are not liable for regulatory penalties you may incur

10. Indemnification

You agree to indemnify Curesh against claims arising from:

• •Your use of the service
• •Your violation of these Terms
• •Your violation of third-party rights
• •Data you upload or process

11. Termination

• 11.1By You: Cancel anytime from account settings
• 11.2By Us: We may terminate for Terms violations with notice
• 11.3Effect: Access revoked, data available for export for 30 days
• 11.4Survival: Sections 6, 9, 10, 12 survive termination

12. Dispute Resolution

• 12.1Governing Law: Laws of Republic of Latvia
• 12.2Jurisdiction: Courts of Riga, Latvia
• 12.3Informal Resolution: Contact us first at legal@curesh.com
• 12.4EU Consumers: May use EU Online Dispute Resolution platform

13. General Provisions

• 13.1Entire Agreement: These Terms + Privacy Policy + DPA
• 13.2Severability: Invalid provisions don't affect others
• 13.3No Waiver: Failure to enforce doesn't waive rights
• 13.4Assignment: We may assign; you may not without consent
• 13.5Notices: Via email to your registered address
